About the Author
Michael Kimelman is a graduate of Lafayette College and the University of Southern California Law School. Formerly an associate at Sullivan & Cromwell, he was the Founder & Managing Partner of Incremental Capital, a New York based hedge fund with over $250 million in assets, which closed shortly after his arrest. A serial entrepreneur, he is currently consulting and launching new ventures in the culinary, retail, and entertainment spaces. He actively volunteers his time to several causes, including prison and education reform. He lives in Mamaroneck, New York.

This is the book to read to learn of prosecutor overreach but also the ways of Wall Street and how they cheat. A promising corporate attorney career is abandoned to pursue a life of stock arbitrage which was so widely popular in the early 2000s. Here, a firm with capital will back various traders in purchases for profit and limit their losses quickly. In theory, some traders are better than others and riding the winners creates large income and this attorney after a somewhat promising trading career sets up a trading operation to seek his fortune. The scale of wealth we are talking about is this trader had not made more than $400,000 in his career so this is not heavy Wall Street money. But some of his traders were piggybacking other trading operations and some traders best talent was taking information that turned out to be purported inside information. The author is caught in just such a prosecution.This guy's life is out of control. Three kids and a wife, but now debts, particularly legal, and management of partners who were the suppliers of the inside information all while living life as an alcoholic. He is offered a plea bargain with no jail time but an admission of guilt which he turns down. This is the first step in the rabbit hole. Some books are boring with paper subjects. This one is not. I work in finance but this author spins a great story quickly and efficiently leading to a great payoff. I couldn't recommend this book higher.
This is part 1 of my review. I will post part 2 after I finish the entire book (and I have had a chance to think about the issues a bit).I bought the book in kindle, and I have read about 50% of the books (I did not read this book in chronological order). I also read the Second Circuit decision denying the initial appeal as the 2017 district court decision denying Kimmelman's motion to vacate, as well as the Elle article.1. overall, a gripping read. Kimmelman writes well, and so far it is an engaging read.2. this book is in part a personal story about Kimelman and his relationship with wife. I thought that his wife's Elle article was most unfortunate, her decision to publish the article without discussing it with her husband reflects breakdown of the relationship.3. Moe is K's close friend from college, and was EDNY AUSA in the beginning of the book. he then joins K's legal team at Wilson Sonsini (i am looking for the section where Moe made the transition)4. K's relationship with his lead lawyer Michael Sommer is quite interesting and puzzling. K does not discuss in the book how his motion to vacate leveled an ineffective assistance of counsel claim against his lead counsel (and by extension, his close friend Moe).
Enjoyed this book throughly. Was very well-written and honest and also an eye-opening insight into the US judicial system as well as the legality and ethics of "insider" trading and how the lines between known, proprietary, illegal insider information and just a hot stock tip based off a rumor, are/were fundamentally blurred. Kimmelman's case showed that if you got any sort of stock tip from a guy wearing a wire, it's automatically illegal. His story is a shame, but he honestly portrays the brutal reality and consequences of getting mixed up with the law. I felt his optimism of knowing he truly felt he didnt do anything, felt his pain when he realized that didn't matter, and felt his suffering of losing his beautiful wife and spending 3 years apart from his loving kids. I love reading books on Wall Street and the financial systems and this book definitely fit the bill and showed things from a different angle.
An absolutely brilliant look at the American criminal justice system and one man's fight against it. This book is simultaneously enlightening, riveting and frightening. A must read for all.
I also worked on Wall Street, in a somewhat different capacity. Since the financial crisis, we've heard calls for increased regulation of the financial industry, more prosecutions, and above all, more people in jail. We hear over and over again that nobody went to jail over the financial crisis. But people did, in fact, go to jail, but for insider trading--in a prosecutorial push that many people think went too far. And what a lot of people don't understand is how heavily regulated the financial industry is already. As a trader, I lived in constant fear of ending my career (and possibly being imprisoned) just for pushing the wrong button on my keyboard. It would be very naive to think that only "bad guys" ended up giving on-the-record interviews or facing charges or actually getting locked up, but it happens to good people as well. I have seen it happen. Michael Kimelman falls into that category.This was a very hard book to read, because it basically confirmed all my worst fears when I worked on the Street--that all it takes is one oversight, one mistake, one lapse in judgement, and it can cost you not only your career, but your freedom, and your entire life. This is a book about bad things happening to good people, which, karmically speaking, isn't supposed to happen. But you will learn that it does happen. The opening scenes, when the FBI arrives at his front door, will be forever seared into my mind. It is exactly how I imagined it. I recommend this book in the hopes that someday a desire for retribution won't cause people to dehumanize an entire industry and want to send them to prison. After you see how the justice system works, you won't wish that on anyone.
WOW! I literally could not put this book down! Michael Kimelman is truly a talented writer. From the moment the FBI is pounding on his door to the visits with his Mom, Dad and 3 young children while he's in prison to the moment in the car where his marriage basically ended, you feel as though you are right there with him. Very emotional yet filled with moments of humor, this an amazing read. Thank you for sharing your story, Michael. It's one that needs to be heard and heard by many.
